1. Introduction

These Terms & Conditions (“Terms”) govern your use of the ResiKEY platform (“ResiKEY”, “we”, “our”, “us”). By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using ResiKEY.

2. Parent Company

ResiKEY is a product of Random Solutions Pty Ltd. By using ResiKEY, you acknowledge and agree that Random Solutions Pty Ltd is the parent company responsible for the operation, management, and ongoing development of the ResiKEY platform. All references to “we”, “our”, or “us” within these Terms & Conditions include both ResiKEY and Random Solutions Pty Ltd.

3. Eligibility

You must be at least 18 years of age to use our services. By creating an account, you confirm that you meet this requirement.

4. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Any unauthorised use of your account must be reported to us immediately.

5. Collection and Use of Mobile Phone Numbers

To provide secure access to the ResiKEY platform, we collect and store your mobile phone number. This number is used exclusively for multi-factor authentication (MFA) to verify your identity when accessing both our mobile and web applications. MFA is delivered via SMS messages, which form a mandatory security requirement.

These SMS messages cannot be opted out of, as they are essential for the protection of your account. Your mobile phone number will not be used for marketing or unrelated communications. When you delete your account, all associated contact numbers are permanently deleted from our systems.

6. Acceptable Use

You agree not to misuse the ResiKEY platform, including attempting to gain unauthorised access, interfering with normal operations, or using the service for unlawful purposes.

7. Intellectual Property

All content, branding, and intellectual property relating to ResiKEY remain the property of Random Solutions Pty Ltd and its licensors. You may not reproduce, modify, or distribute any part of the platform without prior written consent.

8. Privacy & Data Protection

We are committed to protecting your privacy and handling your personal information responsibly. All data collected through the ResiKEY platform, including mobile phone numbers, is managed in accordance with the Privacy Act 1988 (Cth) and aligned with internationally recognised standards such as the General Data Protection Regulation (GDPR) principles.

This means that:

• We only collect personal data necessary to provide and secure our services.
• We do not use your personal data, including your mobile phone number, for marketing purposes without your explicit consent.
• You have the right to request access to, or deletion of, your personal information, subject to our legal and security obligations.
• When your account is deleted, all associated personal data (including mobile phone numbers) is permanently removed from our systems.

9. Limitation of Liability

To the extent permitted by law, ResiKEY and Random Solutions Pty Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the service.

10. Termination

We may suspend or terminate your access to ResiKEY at our discretion if you breach these Terms. Upon account deletion, all associated personal data, including contact numbers, will be permanently removed from our systems.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be subject to the jurisdiction of the courts of Victoria, Australia.
